Treaty between the Government of the Kyrgyz Republic and the Government of Russian Federation
on Cooperation in the Field of Protection of Industrial Property
The Government of the Kyrgyz Republic and the Government of the Russian Federation hereinafter referred to as Parties,
taking into account historically formed relationships between two countries,
seeking to develop trading and economic, scientific and technical cooperation,
assuming that efficient and adequate protection of industrial property is a necessary condition for the development of such cooperation,
recognizing the necessity of creation of mutual favorable terms for the protection of rights of authors and owners of industrial property,
have agreed on following:
Article 1
Parties shall perform and develop cooperation in the field of protection and use of rights to inventions, industrial designs, trade marks and other objects of industrial property on the basis of mutual benefit and equality in accordance with this Treaty and other international treaties to which they have acceded or will accede.
Article 2
Cooperation of the parties shall be directed to:
regulation of issues connected with protection and use of rights to the objects of industrial property;
harmonization of national legal acts in the field of protection of industrial property;
mutual simplification of the procedure for filing and examination of applications for issuance of protection documents of applicants of the Kyrgyz Republic in the Russian Federation and applicants of the Russian Federation in the Kyrgyz Republic;
exchange of information, normative and other documents, as well as the experience and specialists in the field of protection of industrial property.
Article 3
In the field of protection of industrial property individuals and legal entities of one state shall enjoy on the territory of other state those rights and privileges which are provided at present or shall be provided by legal acts of other state to its own individuals and legal entities , as well as those remedies on the same grounds and in the same volume that are provided to their own individuals and legal entities.
In this case, on issues not regulated by this Treaty the parties shall apply provisions of the Paris Convention on protection of industrial property revised in Stockholm on July 14, 1967.
Article 4
Each of the parties shall take necessary measures which provide for:
recognition of protection documents of USSR for the objects of industrial property issued earlier on its territory;
payment of remuneration to authors for use of inventions and industrial designs protected by author's certificates and certificates of USSR in accordance with the legal acts of that state where said use has taken place;
ability to transform author's certificates of USSR for inventions and certificates of USSR for industrial designs into national patents for the remaining term;
