Cooperation Agreement between the Government of the Republic of
Kazakhstan and the Government of the People's Republic of China on Plant
Protection and Quarantine
The Government of the Republic of Kazakhstan and the Government оf the People's Republic of China (hereinafter referred to as the Contracting Parties), in order to ensure the prevention of introduction and spreading of pests at the territories of the Contracting Parties and to provide effective control under exchange and spreading of these regulated objects and in order to strength bilateral cooperation in the field of plant protection and quarantine, have agreed as follows:
Article I
The following terms will be used in this Agreement:
(a) Plants - living plants and parts thereof, including seeds and germplasm;
(b) Plant products - crude materials of plant origin (including grain) and processed products that by their nature or technique of their processing may create a risk for the introduction and spread of pests;
(c) Phytosanitary control - arrangements undertaken to check presence or non-presence of quarantine pests in the plants, plant products and transport vehicles;
(d) Pest - any species, varieties or biotypes of plants, animals or pathogens injurious to plants or plant products:
(e) Quarantine pests -pests potentially dangerous to economics of the territory and thus posing a threat, but not yet in presence or if in presence are under official control and not widely spread;
(f) Regulated non-quarantine pests -a non-quarantine pest whose presence in plants for planting affects the intended use of these plants with an economically unacceptable impact, and which is therefore regulated within the territory of the importing Party;
(g) Regulated objects -any plant and plant product, storage place, packing material, transport facility, container, soil or any other organism, object or material that can be the nidus of spreading of pests and fall into phytosanitary arrangements, particularly under international transportation.
Article II
1. The Contracting Parties support, carry out and develop bilateral cooperation in the field of plant protection and quarantine.
2. The cooperation of the Parties within this Agreement is provided in accordance with the national legislations of the Contracting Parties.
Article III
The authorized agencies of the Contracting Parties will be the following:
- for the Kazakhstan Party: the Ministry of Agriculture of the Republic of Kazakhstan;
- for the Chinese Party: the Ministry of Agriculture of the People's Republic of China and State General Administration for Quality Supervision, Inspection and Quarantine of the People's Republic of China. The Parties shall timely inform each other through the diplomatic channels about the changes of names or functions of the above-named authorized agencies of the Contracting Parties.
Article IV
