Memorandum
of mutual understanding between the Government of the Republic
of Kazakhstan and the Government of the Kingdom of Denmark
(Astana, 11/06/2003)
The Government of the Republic of Kazakhstan and the Government of the Kingdom of Denmark, hereinafter referred to as the "Parties",
Expressing readiness for close interaction within Operation Enduring Freedom regarding the struggle against international terrorism, religious and political extremism at the bilateral level;
In accordance with the resolutions of the United Nations Security Council № 1386 (2001), № 1383 (2001), № 1378 (2001);
Recognizing the application of the Agreement among the State Parties to the North Atlantic Treaty and the other States Participating in the Partnership for Peace regarding the Status of their Forces done at Brussels on June 19, 1995 (PfP SOFA) for personnel participating in activities of the Kingdom of Denmark under this Memorandum, except for cases which cause damage to life and health of the citizens of the Republic of Kazakhstan, as well as material damages;
Have reached mutual understanding on the following:
I. With reference to the request of the Government of Denmark to the Government of the Republic of Kazakhstan to designate a divert airfield for military aircraft of Denmark operating from Manas, Kyrgyzstan, in support of Operation Enduring Freedom, the Government of the Republic of Kazakhstan agrees to designate Shymkent airport (further referred to as Airport) as a divert airfield on the following conditions:
1. Aircraft of Kingdom of Denmark may divert to the airport only in cases of emergency on board, impairing safety of flight and requiring immediate landing of the aircraft, in case of weather conditions below the minimum standards required for landing at Manas, or emergency closure of the Manas runway.
During use of the Airport, The Government of the Kingdom of Denmark is responsible for observing technical requirements for use of the Airport.
The Government of the Republic of Kazakhstan has the right to deny use of the Airport as a divert airfield for unplanned landing if;
- weather conditions are below the minimum required level for landing at the Airport;
- there is an emergency closure of the airport's runway;
- there is a VIP aircraft landing at the airport or taking off from the airport (excluding cases when landing is requested by an aircraft in an emergency situation).
